Suspect in Tai Lam shooting pleads guilty to charges of second-degree murder

Lauren Kestner, Online News and Copy Editor
Hector Hernandez, 20, who was arrested in November after firing three shots on a Ride On bus and killing Blair freshman Tai Lam, pleaded guilty to second-degree murder on May 1 before Montgomery County Circuit Court Judge Michael Mason, according to Montgomery County State's Attorney's Office spokeswoman Emily White. Hernandez, who also pleaded guilty to the use of a handgun in the commission of a violent crime and two counts of first-degree assault, will likely receive a prison sentence of 15 - 45 years at the July 30 sentencing, according to a news release from the Montgomery County State's Attorney's Office.
At a candlelight vigil held the night after Tai Lam's death, friends and family left notes, gifts, flowers and Tai's favorite fruits - apples and oranges - at the center of a small shrine.

Hernandez was arrested on Nov. 7 on charges of first-degree murder after firing three shots into a Ride On bus stationed at the intersection of Piney Branch Road and Arliss Street on Nov. 1, killing Lam and injuring two others. White could not comment on the decision to drop the first-degree murder charges to a second-degree charge because the case is still pending.

Assistant Principal Edith Verdejo hopes that the sentencing will provide closure for a Blair community that is still deeply affected by the loss. "I’m happy the person is going to pay for his crime," she said. "I’m glad the family doesn’t have to go through the trial process and relive the whole thing."

Verdejo acknowledged, however, that the punishment Hernandez receives will never compensate for the loss. "It’s unfortunate because whether or not he pleaded guilty, not guilty or was sentenced to life in prison, it’s still not going to bring Tai back," she said.

Hernandez is currently serving six months in the Montgomery County Detention Center for concealing a deadly weapon in an Oct. 3 incident at Northwood High School. Judge William Simons, who presided over the Northwood case, denied Hernandez bail on Nov. 10, explaining that the Immigration and Customs Enforcement agency (ICE) has filed a detainer for Hernandez.

Gilmar Leonardo Romero, 20, and Mario Ernesto Milano-Canales, 30, accomplices in the Lam case, also face criminal charges in trials scheduled for June 15 and June 22 respectively, according to White. "[Milano-Canales] is charged with three counts of accessory after the fact," she said. "[Romero] is charged with two counts of first-degree attempted murder."

Romero and Milano-Canales were detained Nov. 12 after fleeing to Houston, Texas when warrants for their arrest were issued Nov. 10. They are currently being held without bail at the Montgomery County Detention Center.

15-45 years? Someone who sprays a bus full of people with bullets does not deserve to ever leave prison.

      agreed

I agree. Especially since he could easily have killed several more innocent people. It was sheer luck that he didn't. A lifetime in prison would not be too harsh a sentence. We don't need him back on the streets again. Not now, not in fifteen years, not in forty five.

considering he is a gang member, the many rape attepmts he will have to go through, the hate and probably punishment that he will have to face from other individuals who are from opposite gangs or maybe different race, and possibly self destruction wishes, i think 15 years in jail are enough. i think the monsters would be us and not him anymore because Tai didn't suffer 15 years before dying, he lived 15 or so years and then died in less than a day

      You steal jokes, Boo.

On a different note, who is Edith Verdejo? I've never heard of that assistant principal ever. That said, why does Blair need 5 assistant principals? I smell a power struggle.

They Should Leave Him In Jail Until He Dies. That Is What He Deserves For Killing Someone Very Innocent.

This guy deserves way more since he is an illegal immigrant who commits crime in our country. 15-45 years does not account for all of the possible crimes that Hernandez may have committed. Also, he is 20 years old. Do you really think that by this age you don't know what is right and wrong? This is outrageous.
    • Eli Barnett on May 12, 2009 at 10:52 PM
He does deserve quite a bit more, but not because he is an illegal immigrant.

An illegal immigrant deserves no more punishment than a citizen does.

I think that this guy who killed Tai should be in jail for life. He killed Tai plus he's a illigal immigrant plus we wouldnt have to worry about that guy walking in the streets.
  • Anthony Similton on May 14, 2009 at 10:27 AM
I think the guy should get way more than 15-45 years just because he is an illegal immigrant.
  • no name on May 14, 2009 at 10:28 AM
I think he should never see the light again.
and if they do let him out they need to send him back to his country.
  • monkeyman on May 14, 2009 at 10:28 AM
I believe he should be sent to his country for jail

He deserve to have a life time prison and get death sentence, not just because of Tai Lam its also because of what he did from the past.
  • Mr. Man on May 14, 2009 at 10:35 AM
I believe he should stay in prison for life, b/c if you put him back on the street he will commit more crimes since he is part of a gang
  • dawnice dean on May 14, 2009 at 10:38 AM
I believe he deserves way more time bacause of the charges he has based on Tai and the other victims, his charges with Northwood, and hes also and illegal immergant[everything about this situation is just wrong and he deserves so much more punishment]. Hes not even an american citizen and hes coming over here to another contry to commit a crime. His family probaly came over here to create a better life for them and he repays them with this, and for what? to end up in prison for something that could have been advoided.
  • lola on May 14, 2009 at 10:46 AM
yes,i think they should serve a life time in prison because, that person who shoots in the bus is putting other peoples life in danger and especially the driver because what if he shot the driver, the driver could of had an accident and it would of been worst.
  • Eli Barnett on May 14, 2009 at 10:38 PM
Could someone explain to be why an illegal immigrant committing a crime is worse than a citizen committing a crime and deserves harsher punishment?

I agree he never should be let back out on the streets again, but honestly, whether or not he is here legally has no bearing on how harshly he should be punished for this crime.
  • agree with eli on May 15, 2009 at 10:08 AM
Yes, I agree that that 15-45 years is a bit light for someone like him. No, it has nothing to do with his immigrant status.
